Client Terms & Conditions

SammyD Media - Update as of 20/2/206

The client agrees to:

Attend a consultation with the minimum time of 1 hour OR
Provide a clear brief, schedule, and creative direction prior to the shoot.
Ensure timely access to locations, required permits, and participants.
Acknowledge that failure to do so may affect the final outcome, for which the Photographer/Videographer is not responsible & is not viable for a reshoot, or revision without a fee.

PAYMENT TERMS

Session charged at the agreed amount as seen above.
A 50% deposit is required to lock in your timeslot
Payment must be made in full before shoot, unless disclosed otherwise. Payment plans are available but must be communicated before booking is confirmed.
All payments to be made via bank transfer via invoice details
Please use client name as payment reference and send screenshot via DM or email once deposit has been paid
Deposits & payments are not refundable for cancellations within a 48 hour notice of the agreed shoot date
Payment of invoice confirms intent to book. Booking is only finalised when payment is made & T&Cs are returned signed.

BOOKING POLICY:

Booking is only confirmed once payment is made in full & terms and conditions have been returned to Status Socials and signed.
Booking is considered tentative until terms & conditions are returned signed.

REFUND POLICY

Once the shoot has taken place, no refunds will be issued under any circumstances.
This includes dissatisfaction due to lack of communication, unclear creative direction, not agreeing to participation in consultation or changes of mind by the Client.

RESCHEDULING & CANCELLATION

Bookings can be rescheduled with 24 hours notice
Rescheduling within 24 hours of the shoot may incur a $150 rescheduling fee.
Deposits transfer to the new booking date if
Deposits will be forfeited should a cancellation occur within 48 hours of session time
If you are late to your booking, the agreed shoot time still takes place from the agreed time, to agreed finish time with no compensation.
Force majeure events (illness, natural disasters, emergencies) will allow rescheduling without penalty.

CREATIVE CONTROL

If the Client declines a consultation or fails to provide direction, the Photographer/Videographer will use their professional judgment.
Deliverables are considered satisfactory if they meet the agreed scope.
If client does not like how they look in chosen footage of end product, this does not entitle to a reshoot. Revision edit can be made where possible, but physical changes will not be made to edits to differentiate natural appearances.
Under no circumstances will RAW/Unedited Files be given to the client.

ALTERATIONS

The Client may not materially alter, edit, or manipulate the content in a way that damages the integrity or reputation of SammyD Media without prior written consent. Reasonable resizing for platform formatting is permitted.

COPYRIGHT AND USAGE RIGHTS

Sammy D Media retains full copyright to all work.
All images remain intellectual property of Sammy D Media
The client agrees to the use of content across Sammy D Media online platforms for promotional and portfolio purposes
The Client receives a license for [personal use / marketing use / commercial use].
The Client may not resell, alter, or sublicense the work without written consent.
Upon full payment of all fees, the Client is granted a non-exclusive, non-transferable license to use the final delivered content for the Client’s own marketing and promotional purposes.
Unless otherwise agreed in writing, this license:
Is limited to the Client entity only
Does not permit resale or redistribution
Does not permit transfer to third parties, sponsors, partners, or affiliates
Any extended, paid advertising, broadcast, print, global, or long-term usage requires written approval and may incur additional licensing fees.
The Client must notify SammyD Media in advance if content will be used for paid advertising campaigns.
Failure to disclose paid advertising use may result in additional licensing fees.

PORTFOLIO RIGHTS

The Photographer/Videographer may use the work in their portfolio, website, and social media.
If the Client requires confidentiality, an additional fee may apply.

DELIVERY TIMELINE

ALL content delivery is given a 4 week turn around time for final products.
Video Content will receive 2 revisions in the following order: Video review in order and Video review at full draft stage (effects, sound design included).
Video Review Revision requires 48 hour notice of change. Failing to do so allows Photographer/Videographer to continue the editing process without change.
Final revision of fully drafted content, has a revision time of 7 days. If feedback is not received within 7 days of delivery, loses right to revision of work putting creative control into play.

LIABILITY

The Photographer/Videographer is not liable for:

Missed shots due to delays, guest interference, or venue restrictions.
Weather conditions, lighting issues, or unforeseen technical problems outside of their control

STORAGE & BACK UPS

The Photographer/Videographer will retain project files for 90 days after delivery. After this period, files may be deleted unless the Client arranges paid long-term storage.
If content and project files are lost, this is does not entitle projects being recreated.

MODEL & LOCATION RELEASES

The Client is responsible for securing necessary model and/or location releases. The Photographer/Videographer is not liable for legal claims arising from unauthorized use.
Client is responsible of covering creative spaces cost on top of their booking cost. E.G Studio, Hotel Rooms, Venues etc.
Client is responsible for covering the cost of Media Passes to events where needed. Not providing a media pass for your event withholds the ability for the photographer and videographer to create. Rules & event terms will not be broken.
Where individuals are photographed or filmed as part of the Services, the Client warrants that:
All necessary permissions and consents have been obtained from participants where required; and
SammyD Media may use such content in accordance with this agreement.
If SammyD Media is responsible for securing talent, participants grant an irrevocable right to capture and use their likeness for the purposes outlined above.

BREACH

Unauthorised use beyond the scope of this licence constitutes copyright infringement. SammyD Media reserves the right to invoice additional licensing fees and pursue remedies available under Australian law.
